Betterfit is the trade name of Betterfit Technologies (9540-7904 Québec inc.), a corporation incorporated under the laws of Quebec, with its principal place of business in Quebec City, Quebec, Canada.
These terms govern your use of betterfit.ca, of the Betterfit client portal, and of the software applications we operate (together, the “Service”). By using the Service you agree to them. If you do not agree, please do not use the Service.
These terms cover the Service itself: the website, the portal, and the applications. They do not replace any signed agreement between Betterfit and a client or a contractor.
Where a master services agreement, statement of work, or contractor agreement exists, that agreement governs the engagement, the fees, and the deliverables. If anything in these terms conflicts with a signed agreement, the signed agreement wins.
You may browse betterfit.ca, request an estimate, contact us, refer someone, and apply as a developer. When you submit information through a form, you confirm that it is accurate and that you are entitled to share it. If you provide someone else's contact details, for example in a referral, you confirm you have their permission.
Clients and Betterfit staff access the portal and our internal tools through an account we create. Accounts are personal. Sign-in links and credentials are not to be shared, and you are responsible for what happens under your account.
Tell us at ramzi.benounis@betterfit.ca if you believe an account has been used without permission. We may suspend an account immediately where we reasonably believe it is being misused or where an engagement has ended.

The Service itself, including the site, the portal, our software, and our brand, belongs to Betterfit. Nothing here transfers any of it to you.
Work product created by a developer we place is a different matter, and it is governed by the signed agreement covering that placement. Our standard position is that the client owns the work product their engagement produces. Content you send us, such as a resume or a project brief, stays yours; you give us permission to use it to deliver the Service.
We use a small number of third party providers to run Betterfit, including hosting, database, email, scheduling, AI processing, and accounting. Our accounting and invoicing runs on Intuit QuickBooks Online, and our application connects to a QuickBooks company to prepare and issue invoices.
These providers operate under their own terms, and we are not responsible for their services. The full list of providers, and where they store data, is in our privacy policy.
How we collect, use, keep, and delete personal information is set out in our privacy policy, which forms part of these terms. Privacy questions go to privacy@betterfit.ca and we answer within 30 days.
We work to keep the Service available, but we do not promise it will be uninterrupted or error free. We may change, suspend, or withdraw any part of it, and we will give clients reasonable notice before withdrawing something they depend on.
Except where a signed agreement says otherwise, and except for warranties that cannot be excluded under Quebec law, the Service is provided as is and as available, without warranty of any kind. Estimates, pricing figures, and comparisons published on this site are indicative and are not an offer.
To the extent permitted by law, Betterfit is not liable for indirect, incidental, or consequential loss, or for lost profits, revenue, or data, arising from your use of the Service.
Nothing in these terms limits liability that cannot be limited under Quebec law, including liability for bodily injury or for intentional or gross fault. Where a signed agreement sets a liability cap for an engagement, that cap governs that engagement.
We may update these terms. The date at the top of this page shows when they last changed, and continuing to use the Service after a change means you accept the updated terms. For material changes affecting clients, we will say so directly rather than relying on this page.
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. The courts of the judicial district of Quebec City have jurisdiction, subject to any dispute resolution clause in a signed agreement.
